You can make a claim to his insurance company.  However you may not be successful.  If you knowningly ride with someone that is impaired, the insurance company will take the position that you assumed the risk of being injured when you rode with him?  You should contact a lawyer before talking to the insurance company.  The lawyer may be able to help you defeat the claim that you assumed the risk of injury.
