Q: Am I required to wear a seat belt in Virginia?

A: Virginia is one of about 30 states that are not primary enforcement seat belt law states. This means that a police officer cannot pull you over solely for not wearing a seat belt. If you are pulled over for another reason, such as a moving violation or dead tags, the police officer can issue you an additional citation for failing to wear a seat belt. With that said, it's just plain foolish not to wear a seat belt at all times when you are the driver or passenger of a moving vehicle. Statistics abound that show much higher survival rates for those who are buckled up versus those who aren't.
