Rear end collision occurs when the Jeep pulled over to a just its load
In this rearend collision case, the plaintiff was hauling a mattress on top of his Jeep Cherokee. He was concerned that the load was shifting and began to pull over on the side of the road. As he slowed down the car immediately behind him slowed down but the car behind that car did not slow down. The third car crashed into the rear of the second car and not the second car into the plaintiff’s Jeep. As a result, the plaintiff suffered a whiplash injury to his neck and back. The case was continued because one of the witnesses was transferred by the military to Iraq. On return of the witness to the United States, the case settled.
