Reckless, malicious, or irresponsible conduct should not be rewarded or tolerated. The the politicians in Virginia have capped punitive damages at $350,000. $350,000 may be a suitable cap for damages against a drunk driver who has caused and accident which caused serious personal injury or death. In other situations, a cap of $350,000 is not nearly enough. Consider the situation in the Gulf of Mexico created by BP. PP would glad to be let off the hook for the $350,000 cap created by the Virginia legislature.
What amount of punitive damages can I get against a drunk driver?

Dog Bite - Dog Attack - Pit Bull - Fredericksburg, Spotsylvania | John Harris
Posted by John Harris on Thu, Jun 17, 2010 @ 11:47 AM
The dog's was brand new, purchased two days earlier. The dog, a pit bull, was tied to a tree with a cable which was attached to the D-ring on the collar. The collar was made in China according to the label. Collars made in the USA have the D-ring welded shut. When the coach arrived to pick up one of his players the dog pulled against the tree. The collar's D-ring was not welded shut. As a result, the when the dog pulled the D-ring straighten out which released the dog. The coach was viciously attacked from behind but escaped into his car.

Initiating a Claim: The Road Less Traveled
If you have been in a car or truck accident, and have suffered an injury that the insurance company won’t offer compensation for, you have two choices. You can either:
Say nothing, accept the pain, the additional expense, the decline or loss of income, and the strong possibility that both the quality and length of your life will be less from now on;
Hire an experienced attorney, who may give you a whole new perspective on your situation.
It’s really quite amazing how many of those injured say nothing or try to handle their own claim
